TERMS & CONDITIONS

 

1. Project Fulfillment

1.1 Elie Jones Interiors agrees to provide the scope of works as set out in the proposal.

1.2 In case the client would like to make significant changes to the design in a way that doesn’t align with the original creative brief, the costs of these changes will be charged at an hourly rate of £100 exc vat.

1.3 Concept boards are intended to provide an impression of the finished room/s only and may not be fully representative by depicting similar and not exact items to those actually specified. The Client agrees to provide feedback on all creative work within a reasonable time frame (usually five working days), unless the Client has given prior notification regarding a delay in feedback and a mutually acceptable timeframe has been agreed.

1.4 If a Client deliverable, such as input, approvals or payment is late by more than 10 working days, unless the Client has given prior notification regarding a delay and has been mutually agreed, the project will be considered to be on hold and an invoice will be issued for work to date. Once the deliverable is received, the project will be rescheduled according to current workload.

1.5 In case something is wrong or missing compared to what was agreed in the contract, the Client has two weeks after the design is finished to let Elie Jones Interiors know in writing.
If the Client reports this later, the costs of any additional changes will be charged to the client.

1.6 The Client acknowledges that Project deadlines are subject to the vagaries of the marketplace and the performance of third parties.

1.7 Elie Jones Interiors owns and retains all intellectual property rights subsisting in any and all designs we create until full payment has been received.

 

2. Third Party Contractors and Consultants.

2.1 Elie Jones Interiors will not provide a warranty, guarantee, or certification of any third party consultants or contractors of the project and neither will the Designer be responsible for the quality of their works, materials used, their performance, nor their duration of works. However, the Designer shall supervise them for conformity to his or her design concept if that is offered as part of the proposal.

2.2 Work does not include services from contractors like architectural, plumbing, lighting, and engineering contractors, and neither do they include modifications and alterations to structural, plumbing, heating, electrical, air conditioning, or ventilation systems in the design project.

2.3 Elie Jones Interiors cannot advise on any structural or planning permission elements for the Project, it is therefore the Client’s responsibility to appoint relevant third-party consultants in this respect.

2.4 Elie Jones Interiors is not liable for errors and mistakes in the materials or information supplied by the Client or third parties.

 

3. Purchasing and Procurement

3.1 Purchasing and procurement of lighting and furniture items are provided by Elie Jones Interiors unless agreed otherwise. Orders and procurement of goods on behalf of a Client will not be placed until full payment has been received.

3.2 Stock availability or unforeseen discontinuations of any associated materials and/or products can not be confirmed until full payment of such goods has been made. In the event of stock being unavailable within a reasonable timeframe Elie Jones Interiors will propose viable substitutions for any Goods to be supplied for the Client’s consideration. Any unreasonable delays not down to the Designer then Elie Jones Interiors will advise the Client on the additional payment for any increased sourcing costs incurred.

3.3 In the event of any circumstances arising which result in any potential delay to delivery and/or installation, the Designers shall use reasonable endeavours, where feasible, to suggest ways in which the delay could be reduced or averted, to include, but not limited to, proposing viable substitutions for any Goods to be supplied for the Client’s consideration.

3.4 Elie Jones Interiors cannot guarantee prices of merchandise, interior installation, or other services not performed by him or her.

3.5 Delivery times quoted for FF&E (furniture, fixtures & equipment) items are approximate and are based on information supplied by third parties. Elie Jones Interiors will keep you updated on lead times and estimated due dates, and contact you approximately 1 week prior to furniture being delivered to arrange a mutually convenient date for delivery. Every effort will be made to deliver your goods on time, however Elie Jones Interiors will not be liable if delays beyond our control are incurred. We ask that you ensure necessary access is available for safe delivery. We will do our best to be onsite to quality check larger furniture items before accepting the delivery. However if we are unable to do so and prior agreement with you has been made, we request that you please check all products before signing. Any defects, damages or shortfalls must be reported to Elie Jones interiors immediately.

3.6 We will provide products that are of satisfactory quality, fit for purpose and as described. Furniture or furnishing items may be returned only if faulty or damaged, other return costs incurred after orders have been placed on behalf of the Client are not covered by the Designer. Please note that customised and bespoke items of furniture and fixtures cannot be returned.

3.7 Any product pricing change on FF&E resulting in delayed decisions by the Client will be out of the Designer’s control.

3.8 Variances in natural materials such as fibres, wood, marble and leather etc are to be expected, in these instances samples should be regarded as approximate representation only. All fabrics are susceptible to fading if exposed to strong or natural light for prolonged periods, for which we cannot be held responsible for.

3.9 In order to deliver your items, Elie Jones Interiors may need to share your contact details with our suppliers appointed delivery team and technicians. You hereby agree and consent to the provision of such details (without further contact with you) to the delivery team and technicians for this purpose.

 

4. Photographs and Publicity

4.1 The Client agrees to allow Elie Jones Interiors and/or Designer's representatives to photograph the Project during all stages of including when project is complete, please advise us on accepting this proposal if you do not agree to this. Photographs will be used for business purposes, including, but not limited to: press, publications, online, social media, marketing, advertising, and print. Designer will never disclose address or Client’s name without prior consent.  Costs of photographs and publicity are the responsibility of the Designer. Additionally, if Client or Client's agents document the Project, Elie Jones Interiors shall be given credit as the designer if documentation is released publicly.

 

5. Payment

5.1 Invoices sent by Elie Jones Interiors are due on receipt of invoice.

5.2 If the payment is not received within 5 working days, additional administration costs may be charged.  

5.3 To confirm acceptance of the design proposal, the Client pays a non-refundable deposit as described in the design stage of the proposal.

5.4 The remainder of the design fee will be invoiced as detailed in the proposal.

5.5 Any work that extends beyond the scope of works will be charged at an hourly rate of £100 exc vat depending on complexity.

5.6 If the scope of works changes significantly a revised proposal including design fees will be issued.

6. Cancellation and Termination

6.1 The Client has the right to a cooling off period of 7 working days starting from the date when this Contract was signed by the Client. Working days are days excluding Saturday and Sunday and Bank Holidays. Elie Jones Interiors agrees to refund any deposits paid if the Contract has been cancelled within this timeframe.

6.2 Either party may terminate the Contract by giving written notice (including via email) to the other party. The Client agrees to pay for all services that have been provided to this date and all outstanding unpaid invoices and interest within 5 working days of termination.

6.3 Elie Jones Interiors retains all intellectual property rights in all designs.
